Waste Removal Balham Terms and Conditions
These Terms and Conditions set out the basis on which Waste Removal Balham provides waste collection and related services to domestic and commercial customers within our service area. By booking or using our services you agree to be bound by these Terms and Conditions. If you do not agree, you should not proceed with a booking.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Customer means the person, company or organisation requesting waste collection or related services from Waste Removal Balham.
Services means any waste removal, rubbish collection, clearance, loading, transportation, recycling, disposal or related services provided by Waste Removal Balham.
Waste means any materials, items, rubbish or goods presented by the Customer for removal and disposal as part of the Services.
Agreement means the contract between the Customer and Waste Removal Balham formed in accordance with these Terms and Conditions.
2. Service Area and Availability
Waste Removal Balham primarily operates within Balham and surrounding areas. Service availability may vary depending on demand, access and scheduling. We reserve the right to decline or reschedule bookings where access, safety, distance or capacity make the job impractical or uneconomical.
We do not guarantee that we can serve every address within our wider catchment area at all times. Service is subject to the availability of vehicles, staff and disposal facilities on the requested date and time.
3. Booking Process
3.1 Bookings may be made by telephone, email or online request form where available. A booking will only be regarded as confirmed when we have accepted your request and provided a booking confirmation with an agreed date, approximate time window and price estimate.
3.2 The Customer is responsible for providing accurate information at the time of booking, including:
Nature, approximate volume and type of waste.
Collection address and any access restrictions.
Floor level, parking arrangements and any loading constraints.
3.3 Any price given prior to attendance is an estimate based on the information supplied. The final price may vary where the actual volume, weight, type of waste or access differs from that described at the time of booking.
3.4 Waste Removal Balham reserves the right to refuse a booking or cancel a confirmed booking where:
The Customer has provided incorrect or misleading information.
The waste is hazardous or prohibited.
Safety, access or legal restrictions prevent us from carrying out the work.
4. Customer Responsibilities
4.1 The Customer must ensure that:
There is safe and reasonable access to the waste to be removed.
Any special access instructions, parking constraints and building rules are notified in advance.
Waste is clearly identified and, where applicable, separated as agreed at booking.
4.2 The Customer warrants that they either own the waste or have full authority from the legal owner to arrange its removal and disposal.
4.3 The Customer must not present for removal any waste which is illegal or requires specialist permits unless this has been previously agreed in writing.
5. Waste Types and Regulations
5.1 Waste Removal Balham operates in accordance with applicable UK waste management regulations and duty of care requirements. We will transport waste only to appropriately licensed or permitted facilities.
5.2 Unless expressly agreed, we do not collect certain hazardous or specialist wastes, including but not limited to:
Asbestos or materials containing asbestos.
Clinical, medical or biological waste.
Pressurised cylinders or gas bottles.
Explosive, corrosive, highly flammable or toxic substances.
Chemicals, solvents, oils, paints or pesticides that require specialist handling.
5.3 If, upon arrival, we discover hazardous or prohibited waste which was not disclosed at the time of booking, we may refuse to collect it and, at our discretion, either:
Proceed with the rest of the collection and adjust the price accordingly, or
Cancel the job and charge a call-out or cancellation fee.
5.4 The Customer remains legally responsible for waste until it is collected by us. Following collection, Waste Removal Balham assumes responsibility for the waste and will manage it in line with relevant laws and regulations, including the duty of care under UK environmental legislation.
6. Pricing and Quotations
6.1 Unless otherwise agreed, our pricing is based on one or more of the following factors:
Volume of waste.
Weight or density of materials.
Type of waste and disposal or recycling costs.
Location, access conditions and time required on site.
6.2 Any quotation or estimate given prior to collection is not binding and may be revised on arrival if:
The information provided by the Customer was incomplete or inaccurate.
The volume or type of waste differs from expectations.
Additional labour, time or equipment is required to complete the job safely.
6.3 The crew will assess the waste on site and confirm the final price before commencing work. If the Customer declines the revised price, we reserve the right to charge a reasonable attendance or call-out fee to cover our costs.
7. Payments and Invoicing
7.1 Payment terms
Unless otherwise agreed in writing, payment is due in full on completion of the Service on the day of collection.
We may require partial or full payment in advance for certain bookings, including large commercial clearances or collections outside our usual schedule.
7.2 Accepted payment methods
We accept commonly used payment methods such as cash, major debit or credit cards and, for approved business customers, bank transfer against invoice. We do not accept cheques unless expressly agreed in advance.
7.3 Late payment
If payment is not made in accordance with agreed terms, we reserve the right to charge interest on overdue amounts and to recover all reasonable costs of debt recovery, including legal fees where applicable.
8. Cancellations and Amendments
8.1 Customer cancellations
If you need to cancel or reschedule a booking, you must notify us as soon as possible.
Where cancellation is received at least one full working day before the agreed collection date, no cancellation fee will normally apply.
Where cancellation is received less than one full working day before the booked time, we reserve the right to charge a reasonable cancellation fee to cover our costs.
8.2 Amendments
Changes to the time, date, location or scope of the job are subject to availability and may affect the price. We will confirm any revised charge before proceeding.
8.3 Our right to cancel
We may cancel or postpone a booking where:
Weather, traffic, accidents or other circumstances beyond our control prevent us from attending.
Access is unsafe, unlawful or significantly different from that described at booking.
There is a risk to the health and safety of our staff or third parties.
In such cases, we will seek to reschedule your booking at a mutually convenient time. We will not be liable for any indirect losses arising from such cancellation or delay.
9. Performance of the Services
9.1 We will use reasonable care and skill in providing the Services and will aim to arrive within any agreed time window. Time is not of the essence, and we cannot guarantee exact arrival or completion times due to factors such as traffic and site conditions.
9.2 Our staff will load waste from the agreed collection point. If our team is required to remove items from within premises, upper floors, gardens or outbuildings, this must be agreed at the time of booking and may incur additional charges.
9.3 We may, at our discretion, refuse to move items which, due to size, weight or location, present an unacceptable risk of damage or injury.
10. Damages and Access
10.1 The Customer is responsible for ensuring reasonable access to the collection point, including arranging any necessary parking permits, visitor access codes or building permissions, and informing us of any restrictions.
10.2 While we will take reasonable care when moving waste through buildings or over property, the Customer is responsible for protecting floors, walls and surfaces where necessary.
10.3 We shall not be liable for damage to driveways, paths, surfaces or underground services arising from the weight or movement of our vehicles, provided we have been granted permission to access the area.
11. Liability and Limitations
11.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, or for fraud, or any other liability which cannot be limited or excluded by law.
11.2 Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the Services shall be limited to the total price paid or payable for the specific job giving rise to the claim.
11.3 We shall not be liable for:
Loss of profits, revenue, business, contracts or anticipated savings.
Any indirect or consequential loss or damage.
Loss or damage arising from inaccurate information provided by the Customer.
11.4 The Customer is responsible for ensuring that any items they wish to keep are removed from the waste area prior to collection. We do not accept liability for items mistakenly presented to us as waste and removed as part of the Service.
12. Title and Risk
12.1 Ownership of waste transfers to Waste Removal Balham once we have loaded it onto our vehicle and accepted it for removal, provided payment obligations are met.
12.2 Until the waste is loaded, it remains the responsibility and property of the Customer, and the Customer must ensure that it is presented and stored safely.
13. Data Protection and Privacy
13.1 We collect and process personal data such as names, contact details, addresses and payment information for the purposes of administering bookings, delivering Services and meeting our legal obligations.
13.2 We will handle personal information in accordance with applicable UK data protection laws and only retain it for as long as necessary for legitimate business purposes or legal requirements.
14. Complaints
14.1 If you are dissatisfied with any aspect of the Service, you should contact us as soon as possible with full details of your concern.
14.2 We will investigate complaints promptly and aim to reach a fair resolution. Where appropriate, this may include a partial refund or a return visit to rectify issues, at our discretion.
15. Variations to Terms
15.1 Waste Removal Balham reserves the right to amend these Terms and Conditions at any time. Updated terms will apply to future bookings from the date of publication or notification.
15.2 The version of the Terms and Conditions in force at the time of your booking will apply to that particular Agreement, unless a change is required by law or regulatory obligation.
16. Force Majeure
16.1 We shall not be in breach of this Agreement or liable for delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, accidents, fire, flooding, strikes, utility failures, road closures or changes in law.
17. Severability
17.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
18.1 These Terms and Conditions, together with the details contained in your booking confirmation, constitute the entire agreement between the Customer and Waste Removal Balham relating to the Services and supersede any prior discussions, communications or understandings.
19. Governing Law and Jurisdiction
19.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
19.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
By booking or using the services of Waste Removal Balham, you confirm that you have read, understood and agree to these Terms and Conditions.
